11-2-13 man accused of sexually assaulting woman while she was sleeping

A Lake Mills man has been bound over for trial on a charge that he sexually assaulted a 21 year old woman last month while she was sick and asleep.  Probable cause was found at a prelimnary hearing Thursday for 28 year old James Banker.  He’s charged in Dodge County Circuit Court with second degree sexual assault of an unconscious victim.  According to a criminal complaint, the victim was staying with some friends because she had been ill for a few days and wasn’t getting a lot of sleep.  Banker is accused of sexually assaulting the victim while she slept.  An arraignment hearing has been scheduled for November 20^th.
