4-26-13 fdl judge's rr overpass ruling affirmed

A Wisconsin appeals court has affirmed a Fond du lac County Circuit Court Judge ruling involving Wisconsin Central Railroad and overpass project.  Judge Robert Wirtz denied Wisconsin Central’s motion for an injunction on the Department of Transportation’s taking of soil samples from railroad property for a bridge over  the Lakeshore Drive tracks in North Fond du Lac.  The 2nd District Appeals Court ruled the railroad consented to the limited sampling, a necessary component of the design phase of the overpass project.
